Mud Victims Take Suffering to Nation’s CapitalIt resembled a scene from a bizarre horror film. Hundreds of mud coated creatures taking over Proclamation Monument square in the heart of Indonesia's capital.

In reality, the occurrence in Jakarta on Wednesday (10/12) was an arts performance by some 400 survivors of the Lapindo mud flow disaster.  Women, men, children, families all coated their faces and bodies in mud, taking the term ‘mud victim’ literally.

For over six hours they sat in a stony silence as a statement about the hardship, corruption, poverty, discrimination and injustice they face. Others dragged their bodies around the square to symbolize the de-habilitating affects of the rising mud. All 392 clutched photos of the loved ones and fellow victims left behind in their home villages in Sidoarjo. The participants had traveled more than 16 hours on crowded trains to be part in the unique display of solidarity.

Tired of empty promises and political rhetoric after two years since the mud flow began, the survivors are demanding accountability from Lapindo and the government who they claim to have destroyed the normality of their lives. The performance coincided with the 60th anniversary of the adoption of the Universal Declaration of Human Rights, symbolizing the exclusion of some from its fulfillment.

The performance was organized by Urban Poor Linkage (UPLINK) with the assistance of Dadang Christanto and lasted until nightfall. By its end, the mud had dried and the participants bore a resemblance to Emperor Qin's terracotta soldiers. But unlike those soldiers, the victims of Lapindo are determined not to be buried under the mud. At sunset, they lit candles, and gathered to pray. Where there is light, there is hope, that their suffering will end, and their lives returned.

The following day, representatives of the survivors held a press conference at the KONTRAS office in Jakarta. The group delivered a statement on behalf of the thousands of residents in the villages of Permisan, Ketapang, Siring Barat and Besuki Timur suffering from the effects of the continual mud flow.
These villages have been excluded from the official affected area map of the mud flow, and hence from compensation and accountability. Yet they are suffering from a lack of clean water, contaminated water supplies, damaged facilities and threats to health from the rising carcinogenic mud flow. 4 people have already died from inhaling the contaminated air.  The land subsistence of approximately 268 houses in Ketapang and 215 houses in Siring Barat have been damaged. Destruction of irrigation in Permisan has ruined 865 hectares of land reducing production to 50%. 30 hectares of rice fields can no longer be used in Besuki Timur.

“The government is just not taking our suffering seriously”, stated A. Salam from Ketapang, “our lives are not comfortable and there is no certainty when the mud will stop or how many hectares it will destroy.”

“Because we our outside the map, we are also outside the responsibility, but there are 14 villages still affected by the mud outside the map. The government must take responsibility” said Mundir D.I from Permisan.  

The victims have pledged to continue solidarity demonstrations in Jakarta and Sidoarjo and struggle for their rights if the government and Lapindo refuse to take their suffering seriously.

Victims Rally Turns Violent in Porong

750 Lapindo mud victims have staged a large rally in Porong (4/12), blocking the city’s main road and causing lengthy traffic jams of up to 5 kilometers. The rally begun at 8:30am and continued for 3 hours until negotiations ended with protesters agreeing to move on, but not before violence between the group and police broke out.

Violence broke out later when police tried to clear the crowd for vehicles to pass through the main road between major cities of Surabaya and Malang. Many were injured. Some protesters were hit by the police officer’s batons and pushed aside by shields. It was unknown who started the violence.

‘The problem is that the residents are from four villages, they don't yet know one another. So we do not know which resident started the violence. In fact, there are some policemen wearing civilian clothes and improvising as residents’ said Rofi’i, one of the residents in the Jatirejo village volunteer team.

Three protesters were arrested during the violence and taken to the local police station. At 5:00pm 200 residents blocked the police station, demanding their fellow villagers to be released. They were freed at 7 am.

Siaran Pers: Korban Lumpur Menuntut Presiden Bersikap Tegas terhadap Lapindo

Kami, warga korban lumpur Lapindo, Sidoarjo, yang terusir dari rumah dan tanah kami akbibat kesalahan pemboran PT Lapindo Brantas, menuntut Presiden Susilo Bambang Yudhoyono untuk bersikap tegas terhadap Lapindo. Peraturan Presiden No 14 Tahun 2007 menyatakan, Lapindo membayar tanah dan bangunan warga korban 20 persen di muka dan 80 persen satu bulan sebelum masa kontrak habis (Pasal 15).

Batal Dibayar 20%, Pengungsi Pasar Baru Tutup Tanggul

Ratusan warga Renokenongo sudah dua setengah tahun ini tinggal di pengungsian pasar baru Porong menutup jalan menuju tanggul di desa mereka (08/11). Mereka menuntut uang 20% dari aset mereka yang hingga kini belum dibayar Lapindo. Para warga tak ingin menyebut kegiatan ini sebagai aksi demonstrasi, mereka lebih senang menyebutnya silaturahmi ke bekas desa mereka yang kini tertimbun lumpur.
“Kami hanya ingin bersilaturahmi dan mengenang saat-saat kami masih di desa ini, sekaligus meminta kejelasan kapan 20%nya akan dibayar?” tutur Sunoko, warga Renokenongo. “Kami hanya hanya dapat kertas, tulisan surat bukti pembayaran (Perjanjian Ikatan Jual Beli (PIJB) yang ditandatangani 16 September 2008). Katanya uang akan cair 2 minggu lagi. Namun setelah kami cek lagi rekening kami masih kosong. ”

Data soal berapa jumlah warga Renokenongo yang belum dibayar 20% simpang siur. Menurut warga ada sekitar 1000 kepala keluarga belum mendapatkan pembayaran. Namun menurut Ahmad Zulkarnaen, humas Badan Penanggulangan Lumpur Sidoarjo, ada 495 berkas permohonan pembayaran yang masuk bulan Agustus 2008. Yang jelas semua berkas ini belum dibayar.

Pihak BPLS yang kami mintai konfirmasi mengenai hal ini menyatakan telah melakukan pendekatan terhadap warga untuk menyelesaikan masalah ini, “warga Renokenongo pada bulan Juli 2008 telah kami mintai data aset untuk selanjutnya kami verifikasi dan diserahkan ke fihak PT Minarak Lapindo Jaya,” ujar Zulkarnain selaku Humas BPLS.

Warga selanjutnya menyerahkan berkas mereka pada pertengahan Agustus untuk dilakukan verifikasi oleh pihak BPLS. Ada sebanyak 495 berkas warga yang diterima oleh pihak BPLS. Proses verifikasi sendiri berjalan hingga pertengahan september 2008. Tanggal 16 september 2008 terjadi Ikatan jual beli antara warga dan pihak PT MLJ. “ Proses pembayaran sendiri harusnya dilakukan paling lambat 10 hari setelah terjadinya ikatan jual beli terjadi. Kami telah menghimbau kepada warga bahwa dalam ketika proses pembayaran sedang berlangsung penanggulan juga akan tetap dilaksanakan. Tapi setelah lebih dari satu bulan warga tidak dibayar juga, akhirnya mereka melakukan penutupan tanggul.” Lanjut Zulkarnain.

PT Minarak Lapindo Jaya selaku juru bayar dari PT Lapindo Brantas menyatakan, terlambatnya proses pembayaran diakibatkan oleh terjadinya krisis keuangan global yang berdampak pada perusahaan induk mereka. Pernyataan itu dikeluarkan oleh PT MLJ ketika dimintai konfirmasi oleh pihak BPLS mengenai keterlambatan proses pembayaran ini. “Kami ini orang kecil pak, gak ngerti sama krisis global-krisis global yang dibilang sama orang-orang itu. Kami hanya ingin hak kami yang 20 % dibayar dulu, biar bisa dingin hati warga ini.” Ujar Darto, 50 tahun, salah seorang warga yang ikut aksi penutupan tanggul.

Sebelumnya warga juga mendapat pernyataan akan mendapatkan tambahan jatah hidup untuk satu bulan ketika proses pembayaran telah lewat dari waktu yang ditentukan. “Tapi sampai satu setengah bulan waktunya sudah lewat kami tetap tidak dapat apa-apa sama sekali. Itu yang ngomong pak Suliyono, orang BPLS juga” lanjut Darto. Menurut Zulkarnain ketika kami konfirmasi, seharusnya memang ada pemberian tambahan jatah hidup selama satu bulan ketika terjadi keterlambatan proses pembayaran. “Aturannya memang PT MLJ memberikan tambahan jadup ketika pembayaran 20% itu belum juga terbayar dua minggu setelah terjadi ikatan jual beli. Di pasar baru porong sendiri ada sekitar 2000 jiwa yang tinggal. Jadi PT MLJ harus mengeluarkan dana sekitar 600 jutaan untuk membayar jadup untuk satu bulan.” Ujar Zulkarnain.

Warga sendiri bertekad untuk tetap menduduki tanggul hingga uang pembayaran sebesar 20 persen itu cair. “Kami kurang apa lagi, Pak? kami sudah nurut banget. Ditawarkan resettlement, kami ikut. dilarang demo, kami gak ikut-ikut demo. Tapi sekarang kami ditipu lagi, kami selama ini merasa tidak diperlakukan secara manusiawi. Mana keadilan sosial bagi warga indonesia itu?”ungkap Darto.
Warga tidak akan membiarkan penanggulan dilanjutkan hingga ada kejelasan mengenani pembayaran 20 persen kapan akan dibayarkan, “saya ini sudah 55 tahun, sudah bau tanah. Tapi sebelum saya mati, saya musti berjuang mempertahankan hak-hak kami. Kalau seperti ini terus, sampai mati pun saya tidak akan terima. Arwah saya akan datangi Si Bakrie itu, saya mintai dia pertanggungjawaban,” tandas Darto. [mas]
